1) Scope of Application

1.1 These General Terms and Conditions ("GTC") of Doroast Coffee (hereinafter “Seller”) apply to all contracts concluded with consumers or traders (hereinafter “Client”) regarding the goods and/or services offered via the Seller’s online store www.doroastcoffee.com. Deviating terms from the Client are not accepted unless explicitly agreed upon.

1.2 These GTC also apply to goods with digital elements, digital content, and vouchers, unless explicitly excluded.

1.3 Consumers are natural persons entering into a legal transaction primarily for non-commercial purposes. Traders are individuals or entities acting in the course of their commercial or independent professional activity.

2) Conclusion of the Contract

2.1 Product listings on the website are non-binding. By placing an order, the Client submits a legally binding offer.

2.2 The contract is concluded once:

  • an order confirmation is sent by email,

  • goods are delivered, or

  • payment is requested, whichever occurs first.

2.3 Order processing and correspondence are handled by email. Clients are responsible for ensuring accurate email details and checking spam folders.

2.4 Contracts can be concluded in English or German.

3) Right to Cancel

3.1 Consumers have the legal right to cancel their order within the prescribed timeframe. Full cancellation details and instructions are available on our website.

3.2 Cancellation rights do not apply to products that are made to order or perishable, such as roasted coffee, baked goods, or tickets for specific events.

4) Prices and Payment Conditions

4.1 All prices are listed in Euros and include applicable VAT. Delivery costs are calculated separately and displayed during checkout.

4.2 Payment methods include bank transfer, PayPal, credit/debit card, and other options provided via our payment partner Mollie (https://www.mollie.com).

4.3 For prepayment, the amount is due immediately upon order confirmation.

5) Shipment and Delivery Conditions

5.1 Products are shipped to the address provided by the Client during checkout.

5.2 If delivery fails due to Client-related reasons (e.g., incorrect address), return shipping costs may apply.

5.3 We currently do not offer personal pick-up.

5.4 Digital content, vouchers, and tickets are delivered electronically via email or downloadable links.

6) Granting Rights of Use for Digital Content

6.1 Clients receive a non-exclusive, non-transferable license to use any digital content for private or internal use.

6.2 Commercial redistribution or copying without explicit permission is not allowed.

6.3 Rights become effective upon full payment.

7) Reservation of Proprietary Rights

Ownership of goods remains with Doroast Coffee until full payment is received.

8) Warranty

8.1 Statutory warranty rights apply. Consumers are entitled to remedies in the event of defects.

8.2 For traders:

  • Warranty claims for new goods expire after one year.

  • Used goods are sold without warranty unless otherwise agreed.

  • The limitation period does not restart after replacement.

8.3 Transport damages must be reported immediately upon delivery.

9) Liability

9.1 We accept unlimited liability for:

  • Intentional or gross negligence

  • Injury to life, body, or health

  • Mandatory liability under product liability laws

9.2 For minor negligence in essential contractual obligations, liability is limited to foreseeable damages.

9.3 In all other cases, liability is excluded.

10) Redemption of Campaign Vouchers

10.1 Promotional vouchers are valid only during the specified period and are non-transferable.

10.2 They cannot be redeemed for cash or combined with other vouchers.

10.3 Minimum purchase values may apply. Unused balances are forfeited.

11) Redemption of Gift Vouchers

11.1 Gift vouchers purchased via the online store can be redeemed at checkout.

11.2 They remain valid until the end of the third year after purchase.

11.3 They can be transferred but cannot be exchanged for cash.

12) Applicable Law

Contracts are governed by the laws of the Federal Republic of Germany, excluding UN Sales Law. Consumer protection rights of the Client’s country of residence remain unaffected.

13) Alternative Dispute Resolution

13.1 The European Commission provides an online platform for resolving disputes: https://ec.europa.eu/consumers/odr

13.2 Doroast Coffee is not obliged to participate in any alternative dispute resolution proceedings and does not currently engage in such procedures.
